Decision on admissibility and merits nº AP-825/06 of Constitutional Court, September 29, 2007

The Constitutional Court of Bosnia and Herzegovina, sitting, in accordance with Article VI(3)(b) of the Constitution of Bosnia and Herzegovina, Article 59, paragraph 2(2) and Article 61, paragraphs 1, 2 and 3 of the Rules of the Constitutional Court of Bosnia and Herzegovina (Official Gazette of Bosnia and Herzegovina No. 60/05), in Plenary and composed of the following judges:

Having deliberated on the appeal of Ms. Fatima Mehić in case No. AP-825/06, at its session held on 29 September 2007, adopted the following

DECISION ON ADMISSIBILITY AND MERITS

The appeal lodged by Fatima Mehić is partially granted.

A violation of Article II(3)(e) of the Constitution of Bosnia and Herzegovina and Article 6 of the European Convention for the Protection of Human Rights and Freedoms is hereby established as to the right to have a decision made within a reasonable time in the proceedings conducted before the Municipal Court in Sarajevo in case No. P-1074/89.

The appeal lodged by Fatima Mehić against the judgment of the Supreme Court of the Federation of Bosnia and Herzegovina No. Rev-416/04 of 1 December 2005 and the judgment of the Cantonal Court in Sarajevo No. Gž-2113/03 of 27 March 2004 is hereby dismissed as ill-founded with regard to the allegations stated in the appeal that  relate to Article II(3)(e) of the Constitution of Bosnia and Herzegovina and Article 6(1) of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
